Section H — What happens after you submit
- Acknowledgement. Kallitone will acknowledge receipt of a complete notice. Incomplete notices may be returned for revision.
- Assessment. Kallitone will assess whether the notice is sufficiently precise and substantiated to identify a credible claim. Notices that are manifestly unsupported or abusive may be rejected.
- Interim restriction. Where appropriate and permitted by law, Kallitone may temporarily restrict access to the identified material while the matter is reviewed.
- Creator notification. Unless prohibited by law or necessary to prevent harm, Kallitone may notify the uploader (Creator) and give them an opportunity to respond with evidence.
- Resolution. Kallitone may restore or permanently remove the material depending on the evidence provided by both parties. If the matter remains disputed after review, Kallitone may keep the material restricted until the parties agree or a court or competent authority resolves the dispute. Kallitone's decision about availability on its Service does not constitute a binding legal determination of copyright ownership.
- Repeat infringement. Accounts of users who repeatedly infringe rights may be suspended or terminated in accordance with Kallitone's repeat-infringement policy.
- Internal appeal. A User may request internal review of a Content decision by emailing copyright@kallitone.com within six months of the decision, explaining why the decision was incorrect and providing any new or overlooked evidence.
Section I — False and abusive notices
Do not knowingly submit a false notice, fabricated ownership evidence or misleading statements. Knowingly false notices may result in:
- rejection of the notice and any future submissions;
- restriction or termination of your access to the Service;
- civil liability to the person harmed by the false notice (including actual damages and attorney's fees under applicable law, including 17 U.S.C. § 512(f) in the United States); and
- referral to competent authorities for suspected criminal conduct.
This provision does not penalise a genuine good-faith mistake, legitimate enforcement activity, fair use, fair dealing or another applicable legal exception.
